If the apartment/ space/ building are located on a lease land from RAJUK/ Ministry of Works/ National Housing Authority, then before registration of the apartment in favor of the borrower, permission of the concerned lease land authority to be obtained by borrower / developer and upon obtaining such permission, the registration will be made favoring the borrower. Upon registration of the apartment in favor of the borrower, the borrower will apply for mortgage permission to concerned lease land authority. Upon obtaining such mortgage permission, the borrower will mortgage the property in favor of LankaBangla with IGPA. This process of registration and mortgage will be initiated at the time of handing over of apartment and subject to the completion of permission for registration and mortgage which may take 6-7 months from the date of handing over of the apartment; as a result, in total mortgage formalities may be completed after project completion period plus 3/4 months. So, here lies the risk of non-mortgaging due to non-cooperation of the borrower and/ or developer and/or death of the borrower. In that case, our resort will be to opt. for money loan court act through which we will be able to attach the property and thereafter sale through court. However, this is the industry practice with the above underlying risk. The mitigation here is that since developer is the main owner of the flat, if we go for TPA with renowned developer, they will cooperate with us due to their goodwill and obligation under TPA and hence, in case client does not cooperate us, developer can directly mortgage the property in our favor without registering in favor of the client as covered by TPA terms.
  • Personal Guarantee of the spouse(s) or a family member of applicant (father/ mother/ son/ daughter/ first brother/ first sister) in case the applicant is single. However spouse/family member may be given waiver as co –applicant case to case subject to approval of MCC. But For High Net Worth client, Managing director can relaxed/waive the Personal Guaranty with recommendation of Head of Retail Finance and Chief Credit Officer
  • Post Dated Cheque(s) covering total receivables for the entire loan period (initially 36 nos. PDCs covering each installment up to 3 years, 1 no. balance receivables cheque covering total balance installment amount and 1 no receivable cheque covering total receivable). So as most of the banks do not issue more than one cheque book at a time for their retail clients. It is to be noted here that major clients doesn’t want to provide any blank cheque.
